with the use of or reliance on any such content, goods or services available on or
through any such web sites or services.

Termination
We may terminate or suspend Your access immediately, without prior notice or liability,
for any reason whatsoever, including without limitation if You breach these Terms and
Conditions.

Upon termination, Your right to use the Service will cease immediately.

Limitation of Liability
Notwithstanding any damages that You might incur, the entire liability of the Company
and any of its suppliers under any provision of this Terms and Your exclusive remedy for
all of the foregoing shall be limited to the amount actually paid by You through the
Service or 100 USD if You haven’t purchased anything through the Service.

To the maximum extent permitted by applicable law, in no event shall the Company or its
suppliers be liable for any special, incidental, indirect, or consequential damages
whatsoever (including, but not limited to, damages for loss of profits, loss of data or other
information, for business interruption, for personal injury, loss of privacy arising out of or
in any way related to the use of or inability to use the Service, third-party software and/or
third-party hardware used with the Service, or otherwise in connection with any provision
of this Terms), even if the Company or any supplier has been advised of the possibility
of such damages and even if the remedy fails of its essential purpose.

Some states do not allow the exclusion of implied warranties or limitation of liability for
incidental or consequential damages, which means that some of the above limitations
may not apply. In these states, each party’s liability will be limited to the greatest extent

or unintentionally) Jaswing Group’s rights or property, or the rights or property of visitors
to or users of the Site, including Jaswing Group’s customers. Jaswing Group reserves
the right at all times to disclose any information that Jaswing Group deems necessary to
comply with any applicable law, regulation, legal process or governmental request.
Jaswing Group also may disclose your information when Jaswing Group determines that
applicable law requires or permits such disclosure, including exchanging information with
other companies and organizations for fraud protection purposes. You acknowledge and
agree that Jaswing Group may preserve any transmittal or communication by you with

remedies Jaswing Group may have at law or in equity. You agree that Jaswing Group
may, in its sole discretion and without prior notice, terminate your access to the Site, for
cause, which includes (but is not limited to) (1) requests by law enforcement or other
government agencies, (2) a request by you (self-initiated account deletions), (3)
discontinuance or material modification of the Site or any service offered on or through
the Site, or (4) unexpected technical issues or problems. If Jaswing Group does take any
legal action against you as a result of your violation of these Terms of Use, Jaswing
Group will be entitled to recover from you, and you agree to pay, all reasonable
attorneys’ fees and costs of such action, in addition to any other relief granted to
Jaswing Group. You agree that Jaswing Group will not be liable to you or to any third
party for termination of your access to the Site as a result of any violation of these Terms

and insight into user data management practices.

This includes using the platform for its intended purpose, avoiding misuse or abusive
behavior, and respecting other users and system protocols. Failure to comply with the

Severability and Waiver

Severability

greatest extent possible under applicable law and the remaining provisions will continue
in full force and effect.

Waiver
Except as provided herein, the failure to exercise a right or to require performance of an
obligation under these Terms shall not affect a party’s ability to exercise such right or
require such performance at any time thereafter nor shall the waiver of a breach
constitute a waiver of any subsequent breach.

Translation Interpretation
These Terms and Conditions may have been translated if We have made them available
to You on our Service. You agree that the original English text shall prevail in the case of
